Okinawa, Japan, might very well be called paradise, but for one young Army Soldier out of Torii Station, Okinawa, paradise was turning into a living hell. This Soldier was facing a general court martial where the prosecution staked on the charges of sexual assault, communicating a threat, assault, domestic violence, stalking, and indecent language. Fortunately for the young Soldier, Bilecki was retained, and the man now had a fighting chance to get his life back.
The alleged victim of the assault, who was the Soldier’s wife and her paramour — an Air Force TSgt equally subject to the UCMJ — had recently begun an affair in February of 2020. In March of that same year, the Soldier became aware of the affair and confronted the TSgt. Once the command got involved, a no-contact order was imposed between the alleged victim and the TSgt. However, that did little to stop their illicit affair. Multiple confrontations between the Soldier and the paramour ensued.
On the night of May 27th, the alleged victim created a scenario that she likely thought would save both her and the TSgt from potential consequences. She claimed that the Soldier confronted her and threatened to call military police about the affair and then forced her to engage in oral sex. She knew that if she could obtain the status of a victim of sexual assault, she could simultaneously destroy her husband and protect the relationship with the TSgt. She was wrong.
Bilecki was able to smell the bullshit in the story from a mile away. He conducted his own investigation, and when it came time for the victim and their witnesses to take the stand, he absolutely destroyed them. Their credibility dropped lower and faster than a PFC credit score after purchasing a Mustang at 29% interest.
The result for our client after a 5-day trial was not guilty of all charges and specifications. That’s a full acquittal to include the ridiculous indecent language charge that was tacked on for the fun of it by the prosecution. The prosecution thought they had a slam dunk case, and Bilecki snatched their perceived glory right out from under them. Hats off to the Soldier for being willing to fight back and not let the prosecution intimidate him into pleading guilty to any charge.
