Defending Soldiers' Rights

Violations of the UCMJ Occur All The Time

The 23rd Fighter Group, celebrated for its A-10C Thunderbolt’s close air support, symbolizes extreme dedication to ground troops, akin to historical instances where pilots, like George Welch and Ken Taylor during Pearl Harbor, took to the skies under less than ideal conditions. Their actions, while technically breaches of the UCMJ, underscored a gray area in military conduct under extraordinary circumstances. The Bilecki Law Group draws inspiration from such valor, challenging the military justice system’s black-and-white view of UCMJ violations. With over 20 years of experience, more than 250 court martial verdicts, and representation of over 500 service members, we’ve seen how nuanced these situations can be. Our victories in court martial trials not only vindicate our clients but also challenge the narratives constructed by the military justice system. This understanding motivates our relentless defense of service members, ensuring their actions are judged with the context and complexity they deserve.

Combatting UCMJ Misuse

What Types of UCMJ Charges Does Bilicki Defend?

While we have fought and won many cases at court, we have unfortunately not been called up to defend drunk pilots taking it to the enemy in a combat zone. Hell, we might even defend that case pro bono if it ever came to be. However, we have taken the fight to the military justice system on behalf of good men and women who wear the uniform for a number of other charges. Below you find a list of the types of charges we defend and you’ll see that even the most serious cases fail to scare us away.

  1. Sex Offenses (UCMJ Article 120 & 134): Amidst the vibrant party scene, allegations of sex offenses can surge, affecting Airmen unjustly. True justice for victims doesn’t mean wrongfully ending innocent careers.
  2. Fraud and Larceny (UCMJ Article 121): We tackle cases from wrongful appropriation to BAH fraud, understanding that often, what’s missing isn’t stolen but misplaced, arguing that errors shouldn’t destroy careers.
  3. Assault and Violent Crime (UCMJ Article 128): Defending against serious accusations, we emphasize the right to contest charges in court, regardless of the situation’s gravity or the mistake made.
  4. Drug Crimes (UCMJ Article 112a): With marijuana legalization conflicting with military regulations, we challenge the justice system’s handling of drug-related cases, advocating for fair treatment.
  5. Military Specific Offenses (UCMJ Articles 77-134): Addressing charges from AWOL to conduct unbecoming, we fight for those who’ve erred, pushing against the military’s often unforgiving stance on mistakes.
