No Charges Preferred for Airman in Sex Assault Case After Legal Battle

Sexual Assault
Joint Base Pearl Harbor - Hickam, Hawaii
Air Force Senior Airman – E-4
No charges preferred.

An Air Force Senior Airman stationed at Hickam was accused of sexual assault by his ex-girlfriend. The incident in question occurred during a discussion about their relationship, where the Senior Airman was alleged to have briefly grabbed her neck before immediately letting go, apologizing, and subsequently engaging in what was understood to be consensual sex.

The following day, his ex-girlfriend stopped responding to the Senior Airman’s calls, leading to his contact by a detective from the local civilian law enforcement agency. Although the case was initially handled by the local police, it was later passed to the Office of Special Investigations (OSI).

To address these allegations, the Senior Airman retained an established Article 120 UCMJ sexual assault attorney in Hawaii, Timothy Bilecki. The involvement of Bilecki’s law firm helped lead to the command’s decision to dispose of the case without any UCMJ action.
