USAG Kaiserlauntern Court Martial Defense
Military life often intertwines with alcohol use and young service members' explorations of intimacy, a dynamic as old as time. At USAG Kaiserslautern, this blend of youth and eros can clash with the UCMJ, especially in a country where prostitution is legal but off-limits to military personnel. Arbitrary prosecutions over such matters threaten careers, an issue we're ready to combat, ensuring service members don't face undue penalties for these age-old behaviors.

How To Fight Off Trouble With The UCMJ At USAG Kaiserslautern
There are two certainties when it comes to military life. The first is that alcohol will play a disproportionate role in a young service member’s life. The second is that those young people are then going to have a disproportionate desire to put their private parts on someone else’s private parts. This has been true throughout the centuries, and you can likely trace it back to the time George Washington had too much whiskey and ran Martha’s ye old knickers up the flagpole. You simply cannot remove eros from military life as eros is a part of a young adult’s life. The problem for U.S. service personnel stationed at USAG Kaiserslautern is that this can land them in serious trouble with the UCMJ. Prostitution is legal, regulated, and taxed in Germany, but still off-limits to person’s stationed at Kaiserslautern. This charge, like many others in the UCMJ, is often prosecuted in a fickle and arbitrary manner. With our country facing looming threats from Russia in Europe, we shouldn’t be running good men and women out of the military and seeing their careers ruined over this abuse and misuse of the UCMJ. If you’ve got trouble with the UCMJ out of USAG Kaiserslautern, you’re going to have to fight like hell against this abuse and we’re here to help.
Will The Military Really End My Career Over Prostitution
Not only will they end your career, but they’ll do it in a public and spectacular fashion. That’s because the military justice system doesn’t exist to pursue justice and truth. The military justice system exists to preserve military order and discipline. For this to work, they have to publicly destroy the lives of others just to scare everyone else into compliance. A prostitution charge provides them as good an opportunity to do that as any.
It’s a shame because the only reason your command is so sure of your guilt may be because the Battalion Commander saw you coming into the brothel that he was just leaving. Your First Sergeant is going to tear you a new one and lecture you about morals while he’s just upset that his credit cards are maxed out on massage parlors. There is nothing fair about how the UCMJ is enforced at USAG Kaiserslautern when it comes to prostitution that is legal and regulated in the host nation. Sadly, Article 134 is just one of the articles of the UCMJ that are routinely abused by commands and you’re going to need a staunch military court martial defense to save your career, retirement, and your freedom.
What UCMJ Charges Do You Defend At USAG Kaiserslautern?
U.S. service personnel stationed overseas often find themselves the victim of UCMJ overreach because commands are worried about public perception. They don’t want an international incident on foreign soil and so they pursue charges that would never see the light of day stateside. Below you’ll find just a few of the charges we defend and yes, we have clients fly us in from all over the world to fight on their behalf.
- UCMJ Article 120 or Article 134 (Sex offenses) – These cases can include rape, sexual assault, aggravated sexual assault, abusive sexual contact, sexual assault of a minor, indecent viewing, indecent recording, forcible pandering, indecent exposure, and other Article 120 and Article 120(c) offenses.
Across the service branches, there is a rightful and just campaign to root out sexual assault in the military. Unfortunately, this has created a culture where allegations are treated as objective fact and even when your innocence is proved, commands will still try to end your career. It’s not right and it’s not justice.
Meanwhile at USAG Kaiserslautern, they’ll still destroy you if you get caught paying a pro for a night of wienerschnitzel and chill. If you don’t fight these charges, you can be sure this will be the end of your career. It doesn’t matter if you are six months from retirement, they will take everything from you. You must fight back even if you did pay the lady for some company. - UCMJ Article 121 (Fraud and Larceny) – We defend cases such as conspiracy to defraud the military, BAH fraud, OHA fraud, extortion, larceny, wrongful appropriation, and more. This is a case where being overseas and a cultural or language misunderstanding can land a service member in big trouble. You may have thought you were doing legit business and now, one of the locals are accusing you of theft and fraud.
- UCMJ Article 128 (Assault and Violent Crime) – We represent service members facing charges including murder, manslaughter, aggravated assault, assault, and cases involving self-defense and defense of another. Coming in close second, the one thing that you can be sure Soldiers will do as much as drink and have sex, it’s fight.
Young adults, often aided by alcohol, get into fights. It shouldn’t be the end of your career. The problem is when a simple fight turns into a brawl and a makeshift weapon like a chair or beer bottle gets involved. Now you’re looking at serious charges when, in reality, you may have just been defending yourself or others. - UCMJ Article 112a (Drug Crimes) – We defend cases involving drug possession, drug distribution, drug importation, drug manufacturing, drug trafficking, positive urinalysis cases, tampering with urinalysis cases, and more. These cases often involve illegal controlled substances such as marijuana, LSD, methamphetamines, cocaine, ecstasy, molly, opioids, analogues, and more.
Drugs are as prevalent in Germany as they are in the United States. It is far too easy for U.S. service personnel in Germany to get caught up in the wrong place at the wrong time resulting in drug charges. There are almost always local civilians involved who walk away without so much as a slap on the wrist, while our fine men and women have to stand tall before the UCMJ. - Punitive Articles of the UCMJ 77-134 (Military Specific Offenses) – These include charges such as fraternization, unauthorized absence (AWOL), disobeying a lawful order, conduct unbecoming an officer, and much more.
Some of the charges we see under the punitive articles are just plain silly and this is where commands get aggressive while overseas. Prostitution is an Article 134 UCMJ charge and when possible, the prosecution will pile as many charges as possible on top of it to make a good example out of you.
