A Navy Petty Officer stationed at Whidbey Island was under investigation for the misuse of an electronic device under Article 120 following an incident at a house party. After becoming heavily intoxicated, the Sailor had limited recollection of the event, but there was a possibility that inappropriate photos or videos were taken using his phone.
In response to these potential charges, the Sailor retained a noted Article 120 UCMJ sexual misconduct attorney, Tim Bilecki. Bilecki’s team conducted a comprehensive investigation to ascertain the details of the incident and the contents of the electronic device in question. This investigative work was pivotal in preventing the case from advancing to a court martial.
