In June 2019, an Air Force Technical Sergeant stationed in Okinawa was charged with two specifications of sexual assault under Article 120 at a general court martial. The complainant alleged that the Technical Sergeant had sexual relations with her while she was incapable of consenting due to intoxication. In response to these charges, attorney Tim Bilecki was retained and traveled to Okinawa for the Article 32 hearing.
At the hearing, Bilecki mounted a robust defense, including a thorough cross-examination of the alleged victim. The defense’s presentation at the Article 32 hearing led to a significant development in the case: the government proposed a Chapter 6 discharge, which is an administrative separation in lieu of court martial.
After careful consideration, the Technical Sergeant accepted the Chapter 6 offer.
