Bilecki Averts Charges for Army SGT in BAH Case in Korea

Larceny - BAH (Basic Allowance for Housing) Fraud
Camp Humphreys, Korea
Army Sergeant – E-5
No criminal charges preferred in the BAH fraud case.

An Army Sergeant stationed in Korea found himself under investigation for alleged BAH fraud. To address these allegations, the Sergeant retained court martial lawyer Tim Bilecki.

Bilecki’s team conducted a thorough investigation into the matter. Their findings revealed that the situation was a case of overpayment rather than intentional fraud. This discovery was crucial in differentiating between an administrative error and a criminal act. As a result of their investigation, the defense successfully demonstrated that criminal charges were not warranted.

While the Sergeant was required to repay the overpaid funds to the Defense Finance and Accounting Service (DFAS), the resolution of the case did not involve the preferral of any criminal charges.
