An Army Staff Sergeant stationed at Schofield Barracks came under investigation in July 2019 for BAH fraud. Confronted with the prospect of a criminal conviction and prison time, the Staff Sergeant retained a court martial attorney, Tim Bilecki, for his defense.
The case, investigated by the Criminal Investigation Division (CID), was initially headed towards a General Court Martial. However, Bilecki’s involvement changed the course of the proceedings.
He established that while there was an overpayment in BAH funds, there was no fraudulent intent by the Staff Sergeant. This key distinction, presented to the prosecution early in the case, helped avert the preferral of criminal charges. Subsequently, the command issued a General Officer Memorandum of Reprimand (GOMOR).
