A Navy Petty Officer First Class based in Sasebo, Japan, found himself under investigation for sexual assault following an incident involving a threesome with a male friend and another individual (complaining witness). The Naval Criminal Investigative Service (NCIS) contacted him the morning after the event and informed him that he was under investigation. The Sailor wisely invoked his rights to counsel and retained Japan Article 120 UCMJ sexual assault lawyer Tim Bilecki.
Bilecki conducted a thorough investigation, including extensive witness interviews. This investigation revealed that the sexual acts in question were entirely consensual. The evidence and statements gathered by Bilecki’s firm were presented to the government prosecutors, challenging the initial allegations.
No court martial charges were preferred against the Petty Officer First Class following the submission of findings from the defense team’s investigation.
