An Army Sergeant First Class at Schofield Barracks faced a sexual-assault case built around the complainant’s drinking and alleged inability to consent.
Tim Bilecki took that issue on at the Article 32 hearing. We presented other witnesses whose observations contradicted the degree of intoxication alleged by the complainant. Their accounts gave the hearing officer a basis to test the Government’s incapacity theory against what people had actually seen.
The hearing officer recommended against proceeding. The charges were dropped after the hearing.
