Marine Found Positive for Marijuana in Japan, Retained at AdSep Board

Wrongful Use of Marijuana
Camp Foster Okinawa, Japan
Marine Corps Sergeant – E-5
Retained at administrative separation board.

A Marine Sergeant stationed in Okinawa, Japan, tested positive for marijuana after a urinalysis.  The command sought to administratively separate the Marine with an Other Than Honorable discharge characterization.

Civilian defense counsel Tim Bilecki was retained for the administrative separation board and flew to Okinawa to represent the Marine at the administrative separation board.  At the board, Bilecki put on a defense of innocent ingestion and called witnesses to substantiate our defense.  Remarkably, this defense was successful, and the Marine was retained by the board.
