
An Air Force Major was criminally investigated for sexual abuse of a child after an allegation was made that he sexually assaulted a teen at a party. While the allegations on their face are incredibly serious, an examination of the facts reveled something completely different. The Major was out having dinner and drinks at a friend’s house. There were numerous people there all hanging out and unwinding over dinner and drinks. The Major had a bit too much to drink and wandered to the other side of the house where he passed out shirtless on top the bed in one of the teenager’s rooms who lived there. He had locked the door on the way in, so when he was found locked in the teen’s room shirtless on the bed next to a sleeping teen it was an awkward scene. He was told to leave and later investigated by NCIS for inappropriately touching the teen on his way into the room.
As soon as he was notified that he was under investigation, he retained Guam court martial lawyer Tim Bilecki who interviewed all the party goers at the house on the night in question. It turns out that there was no inappropriate touching, or any touching at all, but it was an awkward series of events that were fueled by the overconsumption of alcohol.
We ensured that no court martial charges were preferred and that no NJP was administrated. Because of his rank, the command felt that some action had to be taken, so the Major was issued a Letter of Reprimand.
