An Army Staff Sergeant was investigated for BAH fraud after the Criminal Investigation Division (CID) conducted an audit on where he received BAH. Military fraud defense lawyer in Hawaii, Tim Bilecki, was retained, and a complete audit was conducted regarding the Soldier’s pay and entitlements.
Bilecki’s audit differed significantly from that of the CID, as was our interpretation of the Joint Federal Travel Regulations regarding where our client was entitled to BAH, given his unique situation.
To end the investigation, Bilecki drafted matters to the command and the Office of the Staff Judge Advocate (SJA), laying out the facts, our interpretation of the regulations, along with supporting documentation. These efforts resulted in CID closing the case without any criminal action being taken against the Staff Sergeant.
