A Marine Staff Sergeant was charged with violating Article 92 (failure to obey lawful order) for allegedly violating the liberty policy to see his girlfriend while deployed in the Philippines.
After he returned, his wife found out he was seeing a Filipina girl on deployment and then accused him of domestic violence prior to filing for divorce. For this allegation, he was charged with a violation of Article 128 (assault consummated by battery).
After the charges were preferred, the Marine retained Tim Bilecki, an established Article 128 UCMJ assault attorney in Hawaii, to defend him. Bilecki was able to negotiate a Separation in Lieu of Trial (SILT).
