Board of Inquiry unanimously found NO BASIS for Separation. Retained in the Navy.
Our client was the subject of a year-long Navy investigation. He was accused of substandard duty performance as well as making false official statements in Violation of Article 107, UCMJ. Based on the investigation, his command was seeking separation from the Navy with an Other Than Honorable Discharge. He was not initially eligible for a Board of Inquiry due to his status as a probationary officer. However, Department of the Navy IG complaints were made regarding the handling of the investigation and our client was ultimately granted a Board of Inquiry. Mr. Bilecki represented this officer at the Board of Inquiry. After a lengthy hearing, the board members found no basis for separation. Our client was retained in the Naval Service.
Many months later, during a subsequent trip to Japan, Mr. Bilecki ran into his client who was still proudly serving in the Navy. We could see the stress had been lifted as our client was in amazing spirits and advancing in his career. It is interactions like this that make all the long hours and tough litigation worth it.
