An Army Specialist faced allegations of sexual assault and domestic violence amid a contentious divorce with his wife, who had lodged multiple false accusations, tarnishing his reputation. The Specialist then retained Tim Bilecki, a skilled court martial lawyer, to navigate these serious charges. Upon taking the case, Mr. Bilecki conducted a thorough investigation, uncovering that the Army’s Criminal Investigation Command (CID) was also probing the Specialist’s wife for consistently making false claims against him. It quickly became evident that these allegations were strategically aimed at gaining an upper hand in their ongoing family court disputes.
Considering these findings, Mr. Bilecki engaged with the prosecution to deliberate on the veracity and motives behind the accusations. His effective advocacy and negotiation skills led to a significant turn in the case’s direction. As a result, no sexual assault charges were preferred against the Specialist. Furthermore, the command chose to address one incident of the alleged domestic violence under Article 15, a non-judicial punishment (NJP), rather than escalating it to a court martial.
