Location: Marine Corps Base Hawaii – Kaneohe Bay , Hawaii Rank: United States Marine Corps , E-6
Charges: Article 120a (stalking) , Article 128 (assault) Article 134 (disorderly conduct). Result: Military matters resolved without a criminal conviction.

Our firm was retained by a Marine SNCO accused of assault, stalking and disorderly conduct by his spouse.  The Staff Sergeant was facing charges in both military court as well as violating a temporary restraining order (TRO) in state court in Honolulu.  Attorney Tim Bilecki investigated the case and determined that the complainant had a motive to fabricate the incident in order to gain an advantage in family court.  We worked directly with the military senior military prosecutor handling the case and negotiated a pre-preferral agreement.  In this agreement, our client would be allowed to separate from the military without criminal charges.
