An Army Specialist faced allegations of sexual assault and domestic violence amid a contentious divorce with his wife, who had lodged multiple false accusations, tarnishing his reputation. The Specialist then retained Tim Bilecki, a skilled court martial lawyer, to navigate these serious charges. Upon taking the case, Mr. Bilecki conducted a thorough investigation, uncovering that the Army’s Criminal Investigation Command (CID) was also probing the Specialist’s wife for consistently making false claims against him. It quickly became evident that these allegations were strategically aimed at gaining an upper hand in their ongoing family court disputes.
Bilecki took those findings to the prosecution. CID was investigating the wife’s false reports while her accusations were being used against our client. We pressed the prosecutor to assess her credibility and the advantage she stood to gain in family court before turning her account into criminal charges. No sexual assault charges were preferred. The command handled one domestic-violence incident at Article 15 instead of court-martial.
