Facts

This was a Reserve Major in the 84th Training Command under an active Army investigation for Article 134 fraternization. The allegation put the Major’s continued service at risk and could lead to disciplinary or administrative action.

Our client retained Bilecki while the investigation was still active and before any disposition decision had been made.

We engaged the chain of command while the investigation was active and presented the disposition question before the investigator’s findings were finalized. The command resolved the matter through NJP. A GOMOR and officer separation proceedings were possible separate actions, but neither followed.

The matter resolved at NJP. The officer was retained in the Reserve.

Result: NJP imposed. No GOMOR. No Show Cause Board. No officer elimination. Officer retained in the Reserve.
