Bilecki Challenges Sexual-Assault Allegation Against Airman in Okinawa; No Charges or Adverse Action

Representation began June 2022

Okinawa, Japan

Air Force E-4

Allegations: UCMJ Article 120 Sexual Assault

Facts

This was an Air Force E-4 in Okinawa under an active AFOSI Article 120 sexual assault investigation, facing court martial referral, federal sex offender registration, and an Other Than Honorable separation if the case carried.

Our client retained Bilecki while AFOSI was still working the file.

The defense investigation put the text messages, social media records, and witness accounts beside the timing of the allegation. Those records showed a dispute with our client shortly before the report, followed by a materially different description of their relationship to investigators. We presented that sequence as evidence of a motive to accuse our client and a reason to question the account AFOSI had been given.

The complainant later stopped cooperating with the investigation.

The investigation ended without court-martial charges or adverse administrative action. No charges were preferred. No NJP. No administrative separation.

Result: AFOSI closed the file. No charges. No NJP. No administrative separation. Airman retained on active duty.

FAQ

Q: What work did Bilecki do during the investigation?
The defense examined the messages, social-media material and witness accounts against the timing of the complaint. Tim’s account confirms that this work identified a dispute before the report and a changed description of the relationship. We presented that sequence to challenge the allegation while the matter was still under investigation.

Q: What was the result?
No court-martial charges, NJP or administrative separation followed, and the Airman remained on active duty. That result does not mean that investigative records were erased or that legal advisers were never consulted.
