Facts

This was an Air Force Technical Sergeant at Robins AFB under an AFOSI investigation that produced a referred general court martial charge sheet on four charges and nine specifications spanning Article 112a wrongful distribution and use of testosterone, Article 120 sexual assault on multiple alleged complainants, Article 128b domestic violence on two intimate partners, and Article 134 indecent conduct. The allegations carried serious criminal and career consequences if proved. Bilecki’s role was the investigation and preferral defense; another lawyer handled the case after our engagement ended.

The Government's case opened in mid 2022 when one of the alleged complainants reported to AFOSI. The investigation pulled in additional alleged complainants from prior duty stations, including allegations dating back to a 2016 deployment. AFOSI conducted screening interviews of female trainees from a prior assignment and identified no additional alleged victims. The AFOSI Final Report of Investigation issued in March 2023.

Our client retained Bilecki at the AFOSI investigation stage in mid 2022.

The defense engaged at the investigation and pre-preferral stages. The defense filed Notices of Representation to AFOSI invoking Article 31. The defense developed a documentary record on credibility of the alleged complainants, including time-stamped phone records, location data, and witness identification work.

Charges were preferred in March 2024. Four charges and nine specifications.

The engagement concluded after preferral. BLG's representation did not continue to Article 32, trial, or final disposition.

Result: Charges preferred March 2024 on four charges and nine specifications; BLG representation concluded after preferral; final disposition outside scope of BLG engagement.
