A Navy Petty Officer Third Class faced charges under Article 107 (False Official Statement) and Article 134 (Solicitation of a Prostitute) of the UCMJ. Tim Bilecki was retained for defense at the administrative separation board. The defense argued that the Petty Officer was unaware he was soliciting a prostitute and maintained that his statements to the command and during the investigation were truthful, countering the false official statement charge. The board hearing included testimony from numerous character witnesses and the Petty Officer himself, who testified under oath.

The administrative separation board, after thorough deliberation, unanimously found no basis for misconduct, resulting in the Petty Officer being retained in the Navy.
