At Fort Shafter, an Army Sergeant First Class faced accusations of burglary and sexual assault. In the wake of these allegations, the NCO retained Hawaii UCMJ defense lawyer Tim Bilecki.  Bilecki’s approach included a comprehensive independent investigation to scrutinize the evidence and the specifics of the incident.

The crux of the case revolved around the accuser’s claim that the Sergeant First Class had entered her room without permission, with the intent of initiating a sexual encounter. This entry constituted the burglary allegation, while the alleged unwanted advance formed the basis for the sexual assault allegation. However, it emerged that the Sergeant First Class and the accusing female Soldier had previously been involved in a long standing consensual sexual relationship. The investigation revealed that the accusations were motivated by personal grievances rather than factual events, leading to significant doubts about the legitimacy of the claims.

The absence of substantiated evidence against the Soldier resulted in the lifting of the administrative FLAG on his record and the case was closed out with no adverse administrative action.
