I am a Chief Warrant Officer in the Marine Corps and stationed on Okinawa. The path I took to Bilecki and Tipon was shattering and terrifying. I was charged with article 80 (Attempts) including four specifications of Art 120 (Sexual Assault) including children, one article 133 (Conduct Unbecoming an Officer). I cannot describe the feelings I had when I realized there were over 100 cases very similar to mine that had been adjudicated as guilty by plea. I am a Specialist in the US Army. I was wrongfully accused of a sexual assault and several other charges were included, all false. After the initial investigation I attempted to help CID, thinking that they were there to simply get the truth. I was a SGT stationed at Camp Humphreys, Korea and I was Falsely Accused of Sexual Assault/Rape in March 2013. I don’t really know how to explain how I was feeling. I was in disbelief. I told myself from the time I got notified by CID that just tell the truth and let God take care of the rest. I figured that it would be so obvious that the “Victim” was using “RAPE” as a way to get sent back to the states from Korea, this is very common. But as the months went by I did some research and found Mr. Bilecki’s videos. After the 32 the General dismissed all the 120 charges. Then I received a Field grade Article 15 for Breaking a barracks policy, alcohol to a minor and Fraternization. I thought it was all done they maxed me out and I did my Extra Duty. The Government then came to me and told me they are initiating a chapter. I retained Mr. Bilecki for the separation board where he again, showed the board that there was no reason to be doing this. The Government “STAR” Witnesses to kick me out, my company commander and 1SG supported me staying in the Army until my ETS which was in 4 months. When the board made their decisions/recommendation they said I would stay in the Army under Probation and if I got in any trouble at all I would be discharged with a General (Under Honorable Conditions). About a month went by and I was told by my commander that I am being discharge General (Under Honorable Conditions) she was so sorry. The General, who sits in a pretty little office on their big chair holding a shiny pen, knows nothing about me or my case really decided that I did not need to stay in the Army and denied the boards probation recommendation. I was discharged September 6th 2014 with a General (Under Honorable Conditions) Discharge.
The reason I say all this stuff above is because without a great Lawyer who believed in me, took my case seriously and was knowledgeable about the Military UCMJ and the shady and wrong things they do to innocent soldiers that can’t afford one. Did it take a lot of money to have Mr. Bilecki represent me? Yes! But that’s the best money I have ever spent. I can’t even begin to thank Mr. Bilecki and his staff for the support and confidence they provided during the whole process. My only recommendation and something I would do different is…Retain Mr. Bilecki as soon as you are accused of a serious crime. You need the Hardest hitting Lawyer you can get. I was suspected, accused and charged of aggravated sexual assault, which is article 120 of the UCMJ. They charged me with aggravated sexual assault even though all I did was had drunken sex, however, in the military when you combine sex and alcohol it's automatically RAPE in their eyes. I was completely devastated when my command actually preferred my charges to article 32 and even more overwhelmed and shattered when I read the potential punishment of this charge to include dishonorable discharge, reduction to E-1, 30+ years in confinement and on top of that sexual offender registry. I felt hopeless helpless and all the doors have closed in my face. Initially, my legal situation seemed daunting. The defense that was orchestrated for me was nothing short of genius. Bottom line up front - I went from nearly certainly getting a General Officer Article 15 (or worse) to getting a locally filed letter of reprimand (which will be shredded and forgotten when I PCS shortly). So essentially I wound up with no punishment besides a good scolding.
Although I did commit some degree of misconduct, this was a sincere case where I was being made into a "fall guy" for several others who had been involved in similar misconduct. When an over-zealous commander thinks you are guilty (even if you are not, or not as guilty as they think) they will stop at nothing to destroy you, regardless of the evidence for or circumstances under which you got in trouble. Expect any constitutional rights to be trampled all over, as well. This is particularly true if they are attempting to suppress information and save face at your expense.
I was consistently intimidated, bullied and harassed by my commander. I specifically recall one day where I called Mr. Bilecki in a pinch when my commander was trying to pin me down with an answer to an arguably illegal question. Mr. Bilecki responded within 5 minutes with a direct phone call to my commander, who happens to be an O-6. The bullying stopped immediately and I didn't hear from him for several weeks. After that, he was much more respectful!
Mr. Bilecki is not intimidated by commanders of any rank, and his confidence helped me to stay strong throughout this difficult time.
Justice was done in my case, but military justice is far from automatic - you need a strong, proactive advocate. You may have gotten in trouble, sometimes serious trouble, but this in no way means you need to allow *anyone* to trample on your constitutionally guaranteed rights. I think this is the essence of Mr. Bilecki's philosophy.
I am still proudly serving in my primary MOS with full potential for career advancement despite initially thinking that would never be an option again.

My son was facing some serious charges by the military of aggravated assault on his child. The military was looking at sentencing him to brig time to up to 17 years of confinement.
