Partner Suspects Infidelity, Accuses Army SGT of Child Porn, Charges Dropped

In August 2018, an Army Sergeant stationed at Schofield Barracks faced an allegation of possession of child pornography. The accusation originated from his boyfriend, who claimed to have discovered child sexual abuse material (CSAM) in the Sergeant’s possession.

This allegation coincided with the boyfriend’s learning of the Sergeant’s activities on dating sites and his involvement with another man. To address these serious accusations, the Sergeant retained Tim Bilecki, a recognized Article 120 UCMJ sexual assault attorney in Hawaii.

Bilecki’s team employed a digital forensic expert (DFE) to thoroughly investigate the claims. The DFE’s examination was crucial in proving that no CSAM existed on any of the Sergeant’s devices. This evidence supported the defense’s position that the allegation was falsely made in retaliation for the Sergeant’s infidelity.

Following the presentation of the investigation’s findings, the allegation was deemed baseless, leading to the dropping of the investigation.
