Under Article 120 of the Uniform Code of Military Justice (UCMJ), "rape and carnal knowledge" are defined and potential penalties outlined. Rape is defined as committing an act of sexual intercourse by force or without consent. It may be punished by death or by imprisonment as determined by court-martial. Carnal knowledge is defined as sexual intercourse with a person who is under 16 years old. Carnal knowledge may be punishable by dishonorable discharge, forfeiture of all pay and allowances and confinement for 20 years. If the alleged victim was under 12 years old, the defendant may face dishonorable discharge, forfeiture of all pay and allowances and confinement for life without parole.
